CDL Disqualification - Administrative Disqualification Law

The standards are different and while not technically a DUI, the two laws bleed together at times. You can be DUI and run afoul of the Administrative Disqualification law, but being DUI is not necessary. Operating a commercial vehicle (CV) with a blood alcohol level of .04% or greater will result in a disqualification for one year. Being under the influence of drugs or alcohol will also result in a year's disqualification. A second DUI in a CV will bring about a permanent CDL ban.

The disqualification is immediate and you receive a 10 day permit in the interim. This permit does not authorize the driver to operate a commercial vehicle for the first 24 hours of disqualification.
